General Terms and Conditions Deluxeside

1. Scope
These general terms and conditions (referred to as “Terms and Conditions – Online Shop”) apply to all legal transactions concluded through the online shop www.Deluxeside.com (hereinafter referred to as the “Online Shop”). Deluxeside reserves the right to amend these terms and conditions at any time. The version valid at the time of ordering shall be applicable.

2. Offer
The products and prices in the online shop are considered an offer. The offer is valid as long as the product is available and in stock in the online shop.

3. Products and Prices
Since the products are slightly different from the originals and are not original shoes, the price is significantly lower than the retail price. The buyer agrees that the products do not come from the original manufacturer and may have variations. Deluxeside.com can set and change prices freely. The price published on the website at the time of ordering shall be applicable. If prices have been mistakenly published, Deluxeside.com reserves the right to inform the buyer before shipping in order to agree on a price correction or cancel the order. Shipping and packaging costs are calculated and displayed separately from the offer price. Any additional charges by the chosen logistics partner will be fully borne by the customer.

4. Provided Information
Deluxeside.com endeavors to keep the published data in the online shop up to date and correct. However, due to production/supply shortages and sales through other channels, there may be delivery delays. Therefore, all information regarding availability and delivery time is provided without guarantee and may change at any time. Deluxeside.com assumes no liability for the accuracy or timeliness of the information provided by other manufacturers, even if they have been carefully researched.

5. Conclusion of Contract
The purchase contract is concluded by submitting the order (online) and the acceptance by Deluxeside.com. A valid purchase contract requires the complete and truthful completion of the order form provided on the Internet and the acceptance of these general terms and conditions (Terms and Conditions – Online Shop) presented here. Deluxeside.com confirms the receipt of the order with an automatically generated order confirmation by email. This confirmation only indicates that the order has been received and that the purchase contract has been concluded subject to the availability of delivery and correct pricing.

6. Delivery Conditions and Pickup

6.1 Availability and Delivery
Products marked as “available” are usually delivered within 11 – 25 working days from the date of order. If a product is not in stock or mistakenly marked as “available,” the customer will be notified by email or phone, and a new provisional delivery date will be agreed upon. Deluxeside.com strives to provide prompt backorders without additional shipping costs. If an item is no longer available and cannot be sourced or produced by Deluxeside.com, Deluxeside.com may withdraw from the contract but must fully refund any payments already made by the customer for the respective product. If Deluxeside.com is unable to provide or ship the items within 60 calendar days from the receipt of the order, the customer has the right to withdraw from the contract. Any payments made by the buyer for the respective product to Deluxeside.com will be fully refunded. There are no further claims against Deluxeside.com. If there are additional shipping costs due to an incorrect delivery address or incorrect address data, these costs will be fully borne by the buyer. Unless otherwise agreed, Deluxeside.com ships national and international orders.

6.2 Additional Delivery Provisions
If the customer does not accept the goods delivered by the supplier within the agreed or specified delivery periods, Deluxeside.com may cancel the contract, cancel the order, and charge the customer a processing fee of 15%, but not less than EUR 30.

7. Obligation to Inspect
The buyer must immediately inspect the delivered or picked up products for completeness, accuracy, and delivery damages upon acceptance. If there is a defect, Deluxeside.com must be notified within 7 calendar days, and the product must be in its original condition for a return.

8. Warranty Conditions and Services
Deluxeside.com sells products from other manufacturers. Deluxeside.com has no influence over the durability, functionality of the products, or the warranty provided by other manufacturers. Therefore, the warranty information provided by the manufacturers applies, provided it is valid under Albanian law. In all other cases, the Albanian statutory warranty provisions apply. A warranty claim can only be made by the customer upon presentation of the purchase contract, including a valid order receipt. There is no warranty claim for damages caused by improper handling or defects resulting from external influences. These could include elemental damages, moisture damages, fall and impact damages, or damages caused by modifications. Deluxeside.com may provide warranty service by providing a new replacement product.

9. Liability and Disclaimer
Deluxeside.com is only liable for the warranty services listed in Section 8. Any further liability is excluded, in particular liability for damages not caused directly to the products themselves. These may include indirect and consequential damages such as loss of profit, unrealized savings, or damages resulting from delivery delays. Furthermore, Deluxeside.com is not liable for damages caused by improper storage.

10. Payment
The invoice amount is to be paid in the currency indicated therein and immediately upon or after submitting the order. The following payment methods are accepted in the online shop: credit cards.
